A federal judge on May 27 stood behind a ruling that blocked restrictions the city of Naples tried to place on a drag show as part of an upcoming LGBTQ “Pridefest.”
U.S. District Judge John Steele on May 12 issued a preliminary injunction against the permit restrictions, finding that they likely violated First Amendment rights.
The city appealed the preliminary injunction to the 11th U.S. Circuit Court of Appeals and requested that Steele issue a stay of his ruling while the appeal plays out. But Steele on Tuesday rejected the stay request, keeping the injunction in place. In part, he said the drag show is scheduled June 7 in the city’s Cambier Park.
“Since Pridefest 2025 and its drag performance are scheduled for June 7, 2025, and the preliminary injunction by its terms expires on June 8, 2025, granting a stay would essentially vacate the preliminary injunction,” Steele wrote.
The group Naples Pride filed the lawsuit to challenge restrictions such as a requirement that the drag show be held inside a building with a 200-person capacity and that minors be barred from attending.
Steele’s ruling Tuesday said Naples did not dispute that the drag show would be “family friendly.”
Steele said he was convinced a preliminary injunction “was justified as to the location and age restrictions after determining that Cambier … is a traditional public forum, where speech receives the highest protection.
The court also found that even if Cambier Park became a limited public forum, the location and age restrictions would violate the First Amendment because they are neither content nor viewpoint neutral.”
Steele’s rulings came as a three-judge panel of the 11th U.S. Circuit Court of Appeals this month separately upheld a preliminary injunction against a 2023 Florida law aimed at preventing children from attending drag shows.

The East Naples wildfire is now 90% contained as mop-up operations continue, according to an update Friday, May 23, from the Florida Forest Service’s Caloosahatchee Division.
The fire, which burned approximately 250 acres since igniting Wednesday, May 21, near Sanders Boulevard and Sabal Palm Road in the Picayune Strand State Forest, was no longer advancing in any direction as of the morning of May 23.
"There’s no forward progression anywhere on the fire currently,” said Michael Harris, public information officer for FFS Caloosahatchee. "It’s got a line around it,” he said. "We’re still working on it and mopping it up.”
Although firefighters have made significant progress, residents may still notice smoke drifting through nearby neighborhoods, especially in east Naples and towards the city of Naples. Harris warned that wind conditions remain unstable, and shifts in the breeze could bring intermittent smoke into residential areas.
"Residents probably will notice smoke today (May 23),” he said. "The wind is just a slightly different direction than what it was yesterday (May 22), so the smoke is going to be heading over toward some of the communities.”
Despite the smoke, there were currently no road closures, and fire officials say the blaze was not threatening homes.
The fire grew quickly Thursday afternoon, May 22, expanding from an estimated 40 acres around 3 p.m. to 250 acres by 7 p.m., before containment efforts gained ground. Multiple agencies responded with equipment and aircraft, including North Collier Fire Rescue District, Bonita Springs Fire Control and Rescue District, San Carlos Park Fire Protection & Rescue Service District, Marco Island Fire Rescue, Estero Fire, South Trail Fire Protection & Rescue Service District, CFR (Airport), Collier County Sheriff’s Office and Collier County Road & Bridge.
By Thursday night, FFS had reduced the number of active tractor-plows on scene from 8 to 4. Fire crews remained on-site overnight to monitor hotspots and prevent flare-ups.
The fire originated from a 38-acre brush fire in East Collier County from Wednesday night, May 21.

The high in Naples is forecast to be 93 degrees every day through Memorial Day, and humidity levels will be high according to the National Weather Service in Miami, which covers the Collier County area.
"It's going to be a couple of degrees warmer than usual," said George Rizzuto, a National Weather Service meteorologist in Miami, the office that covers the Collier County area. "We have light flow, light winds each day, and that will allow us to heat up a little more than usual."
Rizzuto said rain chances will vary from 30% to 50% through the holiday weekend.
"That's the typical early evening thunderstorms that we start to see at this time of year," he said. "Most of the rain should stay over the Everglades, in the less populated areas, but Naples could see some rain as well."
Most years, the summer rain patterns have already established themselves by Memorial Day weekend.
"May 15 is the average beginning of the rainy season for the past few decades," Rizzuto said. "But we still can't nail down an exact date for this year because it varies every year."
Overall, look for conditions to be hot and humid, with an afternoon sea breeze developing along the coast.
The region needs rain as Collier County is listed as being in an extreme drought, according to the National Oceanic and Atmospheric Administration, or NOAA.
Although heavy rains fell earlier in May, Collier is still several inches below normal for rainfall this calendar year.

"It's the start of what we're going to get more and more of this summer," Rizzuto said. "It's the start of that prolonged heat bubble we seem to be in every summer. It will be 90 to 95 every day from now until November."
"It actually won't last until November, but it will feel that way," he joked.
Collier and Lee counties are the driest two counties in the state, according to the Florida Forestry Service.
Both counties rank between 550 and 599 on the Keetch Byram Drought Index, which measures moistures in the soil and create a risk rating.
The scale ranges from 0 for super wet times to 800 for really dry period.
NOAA is calling for above-average temperatures and above-average rains over the next three months.
