Virginia daycare fights to keep license after child found wandering outside

CHESTER, Va. - A Chester, Virginia, daycare where a child was found wandering in a busy road last month is contesting the state's attempt to revoke its religious exemption which allows it to operate.

The Virginia Department of Social Services (DSS) cited Fortress of God Childcare for violations after a 17-year-old employee was left alone to supervise four children ages 3 to 5 on Feb. 21. During that time, the 17 year old left the kids alone for 6 minutes and one child escaped the facility and got onto West Hundred Road.

Four days later, the Virginia Department of Education (VDOE) notified the daycare's administrator of its intent to revoke the religious exemption that allows the facility to operate. A religious exemption is required for religious childcare centers in the state.

Fortress of God has appealed the VDOE's decision, and an informal conference in the case is scheduled for April 9, the agency confirmed to WTVR reporter Melissa Hipolit.

In the meantime, the daycare's administrator told Hipolit she has made significant safety improvements, including bringing in experts to train her and the staff. The Chesterfield Fire & EMS also confirmed the adminstrator has addressed all fire code violations at the facility.

The VDOE previously stated that a notice of intent to revoke a religious exemption does not automatically require a daycare to cease operations immediately. A final decision will be made by a hearing officer.

Fortress of God Childcare remains open as it contests the state's effort to shut it down.

Frazier, a respected coaching veteran and proven recruiter, rejoins the Hokies after serving as an associate head coach at West Virginia.

“We are thrilled to welcome Chester, his wife, Sarah, and children, Chandler, Cameron and Courtney, back to Blacksburg,” Young said. “His passion, energy and tireless work ethic are exactly what we need. Chester has a deep understanding of our program’s culture, and his ability to connect with players, recruit at a high level and develop talent will be invaluable as we move forward.

“He has been a winner everywhere he has been. I am fortunate to call Chester a dear friend and am fired up to work alongside him once again.”

Frazier brings more than a decade of coaching experience from the ACC, Big 12 and Big Ten conferences to the Tech men’s basketball program.

In his one season in Morgantown, Frazier and the Mountaineers went 19-13 overall and 10-10 in Big 12 play, narrowly missing out on the NCAA tournament. WVU posted top-25 wins over No. 3 Gonzaga, No. 24 Arizona, No. 7 Kansas and No. 2 Iowa State along the way. Further complementing his strong relationships with players, Frazier helped assemble the No. 23-ranked recruiting class in 2025 for the Mountaineers.

Frazier, an Illinois alumnus, spent three seasons (2021-24) at his alma mater as an assistant coach under Brad Underwood, prior to WVU. The Baltimore, Md., native helped lead the Illini to the NCAA Elite Eight in 2024, an NCAA Second Round appearance in 2022 and an NCAA tournament appearance in 2023. He helped guide Illinois to the Big Ten regular season championship in 2022 and Big Ten tournament championship in 2024. Illinois won 72 games in three seasons with Frazier on staff.

During his first stint at Virginia Tech (2019-21), Frazier served as associate head coach, helping guide the Hokies to a third-place ACC finish and an NCAA tournament appearance in 2021. The Hokies ended the season ranked No. 25 in the final Associated Press poll.

CHESTER, Va. — The Virginia Department of Education intends to revoke the religious exemption granted to Fortress of God Childcare after a child from the daycare was found wandering in a nearby road on Friday.

An exemption is required for a religious childcare facility to operate.

Under Virginia's state code, religious institutions that run daycares are exempt from a number of state licensure requirements that would be required of a typical non-religious affiliated child day center, but they have to have to file a "statement of intent to operate a child day center” to the state.

Any person who operates a childcare facility without a license or religious exemption can be charged with a misdemeanor.

VDOE Senior Communications Advisor Todd Reid said the letter of intent to revoke "does not mean that they have to cease operations immediately. This begins the process that proceeds until a decision has been rendered by the hearing officer."

VDOE's Assistant Superintendent of Child Care Health and Safety signed a letter dated Feb. 25 that was sent to the daycare’s Administrator Monique Ede announcing the state’s intent to revoke the exemption.

In the letter, Wiliams states that based on findings from inspections in January, October, and December last year, and January this year, the state determined the facility was in violation of several state codes, which placed the “health, safety or welfare of children at risk.”

Those inspections were different from the incident on Feb. 21 when a 3-year-old from the school ran into the road.

However, the letter does reference that incident and states the “department reserves the right to amend this Notice of Intent to include any findings of noncompliance in response to the incident on February 21, 2025 when a child was found off-site and unsupervised.”

The facility's religious exemption expired on Dec. 3 last year, but the state did not receive completed paperwork to renew the exemption at Fortress of God Childcare until Jan. 28 this year.

Yet, the daycare remained open, and the state even visited the facility for an inspection in late December due to a complaint, which the state validated.

"Typically a facility that is already open is allowed to stay open while it completes its paperwork. We allow them to operate in good faith if they are moving forward so that we don't displace children. In this case there was a lot of back and forth because of confusing paperwork submitted by the religious organization that needed to be resubmitted," Reid said.

One day before the state’s letter stating its intention to revoke the facility’s religious exemption, VDOE sent a letter to Fortress of God stating its request for exemption had been approved and retroactively reinstated the exemption starting on Dec. 4 last year.

VDOE said that the letter sent on Monday was something issued “in the normal course of business.”

The daycare has 15 days from receipt of the intent to revoke notice to appeal the decision.

If they do not, VDOE can move forward with issuing an order to revoke the religious exemption.
