After fearing their dog might be euthanized after biting a woman, a Burbank family is breathing a sigh of relief after a judge ordered the dog be returned to its owners under specific conditions -- and not euthanized.
Los Angeles Superior Court Judge Alison MacKenzie issued her ruling Tuesday in the petition brought Aug. 21 by Nelson Grande and Sylvia Franco, owners of an 8-year-old pitbull/Labrador mix named Conan, against the city of Burbank.
In July, the city of Burbank deemed Conan dangerous and called for him to be euthanized, prompting the dog's owners to file their petition.
Advocates seek clemency for pet dog
A Burbank couple was in court today to fight for keeping their pet dog Conan from being euthanized.
"While the court concludes that Conan is a vicious dog, it does not find that the city has established by a preponderance of the evidence that releasing Conan to Grande and Franco would create a significant threat to the public health, safety and welfare such that Conan should be euthanized," MacKenzie wrote.
The conditions set by MacKenzie for giving back the dog to Grande and Franco include proof of rabies vaccination and licensing; that he be properly designated as a vicious animal; that he only be allowed off the property on a leash and wearing a muzzle; and that he be kept in a secure enclosure or in an outdoor place where Conan cannot escape.
Franco, Grande and the victim of the dog bite, Deborah Drissi, were among the witnesses who testified in the nonjury trial.
Although Franco contended that Drissi provoked the animal's attack, the judge said the evidence proved otherwise. MacKenzie also disagreed with Franco's contention that Conan was protecting him when he attacked Drissi.
The judge said the preponderance of the evidence shows Conan came out of a gate, approached Drissi and then leaped up and bit her on one arm.
Former Los Angeles County Sheriff Alex Villanueva and his wife, Vivian Villanueva, a retired LASD member, spoke on behalf of Conan last week outside of court.

A Burbank family is fighting to save their beloved dog, Conan, who is at risk of being put down after biting a woman he was reportedly trying to protect his owner from.
Conan’s current caretakers, Nelson Grande and Sylvia Franco, argue that the 8-year-old pit bull acted out of protection and self-defense against their neighbor who had allegedly been harassing the dog for months.
Conan’s fate will be decided in court at his final appeal on Tuesday afternoon.
According to their family spokesperson, Shira Scott-Astrof, Conan was walking with his “mom” in the alleyway next to their Burbank home in January when their neighbor approached, got in Franco’s face and the pup gave a warning bite.
Scott-Astrof said that the woman had been tormenting the dog for some time before this – yelling, screaming and cursing at him through the family’s gate.
“If a dog is provoked, they have every right to defend themselves and their owner,” said Scott-Astrof. “You can’t punish them for that.”
In July, the city of Burbank deemed Conan dangerous and called for him to be euthanized. Since then, the pup has gained traction online and supporters say that euthanizing Conan is against the law.
KTLA’s Rachel Menitoff spoke with the family on Monday, who say they consider Conan to be more like a grandchild than anything else.
“Our son moved away, so he basically occupies that space in the heart, when the children move away, he filled it up,” said Grande.
It was Grande’s late mother who encouraged them to adopt Conan, who was part of a large litter and at risk of being put to sleep.
“It was a gift from his mom before she passed away, and that’s why he’s more dear to us because it’s a gift,” said Franco.
The couple said life without Conan is unfathomable.
“I couldn’t live without him,” said Grande. “I don’t want to think about being without him.”
According to Burbank bylaws, “no animal should be declared dangerous or vicious if it’s protecting a person from an unjustified attack or if there was teasing, tormenting, abusing or assaulting of the animal.”
Conan’s last appeal will take place at 1:30 p.m. in downtown Los Angeles, and his owners will be testifying along with a dog behaviorist from Florida.
KTLA reached out to the City of Burbank and the City Attorney who say they can’t comment on pending litigation.

While pilot Hal Jordan is arguably the most famous (and most continuously published) member of the Green Lantern Corps, it’s his replacement Lantern, John Stewart, who receives this honor. While John might not have as many comics to his name as Hal, he’s important for more real-world reasons. He’s the first Black American superpowered hero in DC Comics. John Stewart first appeared in 1971’s Green Lantern/Green Arrow #87. A headstrong young architect, the Guardians of the Universe chose him as Hal Jordan’s backup Green Lantern for Earth. Although there were already Black heroes at DC, John was the first with powers. He made a handful of appearances in the ’70s. However, in the ’80s, he took over for Hal full-time as G.L. of Sector 2814. In the ’90s he would receive his own spin-off, Green Lantern: Mosaic. But it was in the early 2000s, when the animated Justice League series hit Cartoon Network. Millions of kids watched that show, and it featured Stewart as the League’s resident Lantern. This truly made John Stewart a superstar. His upcoming live-action role in the upcoming Lanterns series, where Aaron Pierre will play him, will only serve to make John even more popular.
The new Green Lantern statue is located at Hanger 18, 1775 North Victory Place, in Burbank, CA. Artist and DC President Jim Lee was on hand for the unveiling, along with several other DC Comics creators. The statue design was inspired by artist Jamal Campbell. To honor the city’s newest statue, DC also commissioned an exclusive comic, Green Lantern John Stewart: Global Guardian, written by John Ridley and Charlotte Fullerton McDuffie with art by Amancay Nahuelpan, CHRISCROSS, and Jordi Tarragona, with cover art by Jamal Campbell.

“We’re super proud of this,” Lee tells Nerd Reactor during the unveiling. “[The] art was designed by Jamal Campbell, McFarlane Toys did the digital sculpt of this, and I think it’s the most powerful one so far. And it’s just so amazing that we’re able to add more and more of the DC pantheon to the beautiful city of Burbank. Our heroes are protecting the city, but it’s also the home of DC Comics.”

“John Stewart represents an important milestone in DC history as our first modern Black costumed superhero, debuting in Green Lantern #87, published in October of 1971,” said Lee during the ceremony. “For writer Dennis O’Neil and artist Neal Adams to create a character like John Stewart was nothing short of visionary, as it broke a lot of the usual conventions when it came to superheroes, including his being one of the few to not wear a mask in his role as a Green Lantern to hide who he is. He’s John Stewart, period.”

Visit Burbank Sponsors Seven-And-A-Half-Foot Bronze Statue of DC’s Iconic Super Hero
Funded by Visit Burbank, Green Lantern joins statues of Batman and Wonder Woman as ideal selfie spots in the City. The colossal statue will help showcase Burbank as a leading tourist destination and will exemplify the City’s status as the “Media Capital of the World.”
As a key member of DC’s Green Lantern Corps, John Stewart’s comic book exploits not only gained a legion of loyal comic book fans, but his animated appearances in DC and Warner Bros Animations Justice League and Justice League Unlimited provided a new generation of fans with a Green Lantern they could call their own. John Stewart represents an important milestone in DC history as our first modern Black costumed superhero, created by writer Denny O’Neil and artist Neal Adams, and first appearing in Green Lantern #87, published in October of 1971. The art for this statue was inspired by DC rising star, Jamal Campbell. The final larger-than-life statue, made from bronze, was built by skilled artisans at Burbank’s own American Fine Arts Foundry and Fabrication.
