Georgia tax court
Ballot question:Shall the Constitution of Georgia be amended so as to provide for the Georgia Tax Court to be vested with the judicial power of the state and to have venue, judges, and jurisdiction concurrent with superior courts?
Explanation:
Georgia wants voters to decide on whether the state should move the state's Tax Tribunal to the judicial branch. Right now, the Tax Tribunal is part of the executive branch, which the Department of Revenue also falls under. And currently, if taxpayers across the state seek to appeal a decision of the Tax Tribunal, they must first appeal to the Fulton County Superior Court. The Tax Court would separate powers by moving it out of the same branch as the Department of Revenue and allow appeals to go to the statewide Court of Appeals.
If created, the chief tax court judge would serve four-year terms, much like now. Just as the procedure is now, the governor would appoint them with approval from Georgia's Senate and House judiciary committees.

Local option homestead property tax exemption
Ballot question:Shall the Constitution of Georgia be amended so as to authorize the General Assembly to provide by general law for a state-wide homestead exemption that serves to limit increases in the assessed value of homesteads, but which any county, consolidated government, municipality, or local school system may opt out of upon the completion of certain procedures?
Explanation:
This constitution amendment, if passed, would authorize the Georgia General Assembly to implement a statewide exemption from ad valorem taxes. It would create statewide uniformity similar to exemptions several counties already have, like DeKalb, Gwinnett, and Forsyth.
It would also create an option for local governments and school systems to opt out.

ATLANTA — On Election Day, a majority of Georgia voters chose more than just who they wanted for the next President of the United States.
In addition to picking former President Donald Trump to return to the White House in January, more than 50% of Georgia voters also approved three ballot measures related to taxes and property values.
As a result, homeowners and other Georgians will benefit from a broader homestead exemption and will also see the creation of a Georgia Tax Court.

Constitutional Amendment 1:

Referendum A:
A BILL to be entitled an Act to amend Article 2 of Chapter 5 of Title 48 of the Official Code of Georgia Annotated, relating to property tax exemptions and deferral, so as to increase a statewide ad valorem tax exemption for tangible personal property; to specify the terms and conditions of the exemption and the procedures relating thereto; to provide for applicability; to provide for related matters; to provide for compliance with constitutional requirements; to provide for a referendum, effective dates, and automatic repeal; to repeal conflicting laws; and for other purposes.
Here’s what the ballot items will do
Constitutional Amendment 1:
Constitutional Amendment 1 allows municipalities to put a limit on how much a home’s value can be increased each year due to inflation.
That means that the value of a home will not increase more than the rate of inflation, as reported by the Consumer Price Index from the U.S. Bureau of Labor Statistics.
As written, the amendment works through a two-fold setup.
The value of a homestead, where you actively reside, will not be increased more than the inflation rate each year.
Additionally, it creates a new option for local sales taxes, which would act as a supplement the collection of property taxes. Even though voters approved the amendment, local municipalities are still able to opt-out of the exemption, but must vote to do so by March 2025.
The municipalities and local government officials the amendment is focused on include county commissions, consolidated government officials, elected city leaders like council members or mayors if they have the power to change tax rates and Board of Education members.
Constitutional Amendment 2:
Constitutional Amendment 2 will create the Georgia Tax Court for tax-related court cases. Now passed, the Georgia Tax Court would be in the judicial branch and replace the Georgia Tax Tribunal, which is currently part of the executive branch.
The Georgia Tax Court, once created, will rule on cases involving tax disputes between businesses and the Georgia Department of Revenue. Currently, all appeals go through the Fulton County Superior Court, which is not an appellant court. The move is expected to take some of the load off of the current court docket.
Like the current Georgia Tax Tribunal, judges for the Georgia Tax Court will be appointed by the Governor. The appointments will be subject to approval by majority votes in the Georgia Senate Judiciary Committee and the Georgia House Committee on Judiciary.
Referendum A:
Now passed, Referendum A gives Georgia property owners more wiggle room when it comes to filing exemptions on their property taxes.
Currently, the Georgia personal property tax exemption caps at $7,500 for ad valorem payments. As a result of the referendum, the value limit will be increased to a $20,000 exemption.
According to the legislative text for the item, “All tangible personal property of a taxpayer, except motor vehicles, trailers, and mobile homes, shall be exempt from all ad valorem taxation if the actual fair market value of the total amount of taxable tangible personal property owned by the taxpayer,” up to $20,000.
Lawmakers wrote in the bill that it was intended to ensure “the payment of ad valorem taxation certain tangible personal property on which the tax due does not exceed the reasonable cost of administering and collecting the tax.”
The provision will take effect in the following tax year, beginning Jan. 1, 2025.

GEORGIA, — As Georgians head to the polls for Election Day 2024, officials anticipate reporting results by the end of the night, mainly due to a smooth voting process and early voting turnout according to Georgia Secretary of State Brad Raffensperger at a news conference on Tuesday.
Over 4 million ballots were cast during early voting, with more than half of Georgia’s 7.2 million registered voters already participating. An additional 1 million votes are expected by the time polls close, marking another significant turnout for the Peach State.

Raffensperger, speaking at a news conference, emphasized efforts to enhance voter security and speed in reporting. Raffensperger noted that voters have experienced short wait times, with average check-in times under a minute.
"It’s been smooth sailing by and large," he said. “Average line time in Georgia right now is two minutes."
According to Senate Bill 189, which mandates reporting early and absentee ballots within one hour after polls close at 7 p.m., nearly all early votes should be in by 8 p.m., Raffensperger said. Smaller counties aim to finalize counts by 10:30 p.m., positioning Georgia to have a clearer election outcome than in past cycles.
Though the election has progressed smoothly, some residents reported confusion over polling location changes, an issue Raffensperger said his team had not observed widely. Additionally, Cobb County voters who received absentee ballots late can vote in person if they nullify them at precincts by 7 p.m.
Raffensperger also addressed minor security concerns, including one threat linked to Russian-origin cyber activity, but he emphasized that these were under control.
"They're up to mischief," he said. They don't want us to have a smooth, fair, and accurate election. They think they can get us to fight among ourselves."

However, it's worth noting that registered voters don't necessarily mean active voters.
ATLANTA — 11Alive is breaking down some of the most commonly asked questions surrounding Election Day. Among the topics on residents' minds is just how many registered voters there are in Georgia.
According to the state's Election Data Hub, there are roughly 8.2 million registered voters in the state (8,249,917 to be more precise).
However, it's worth noting that registered voters don't necessarily mean active voters. To be considered active, you need to have voted sometime in the last five years. For more information on the specifics, check out the section below.
Anyway, if you take a look at the number of active voters, the number is closer to 7.2 million (7,243,942 to be more precise).
As you can find at this data hub produced by the Georgia Secretary of State's Office, the number of total "active" voters is a bit smaller than our number above: 7,007,154.
That's because the state distinguishes between any voter and "active" voters.
This has to do with some regulations about when and how the state can remove people from the voter rolls. Some voters, who haven't participated in elections recently, get moved to "inactive" status (they can still go vote and be returned to "active" status, but being classified as inactive does move them closer to eventually being removed from voter rolls.)
The Secretary of State's Office confirmed for 11Alive the number on the state data hub is in fact just active voters. They told us the number of active voters is actually a little larger than displayed - 7,008,203 - and that there are additionally 858,474 inactive voters.
That's how we come to a total population of registered voters in Georgia as 7,866,677. Any of them will be able to vote on Tuesday in the runoff - you don't have to vote in November to be eligible for the runoff, and in fact independent trackers report just under 78,000 people who didn't vote in November have already voted in the runoff.
But, new provisions in state law determining the runoff timeline essentially meant no new unregistered voters were able join the voter rolls if they waited until the midterms to do so. That's because the last day to register to vote in time for the runoff was Nov. 7 -- the day before the general election.
